Keyamo Analyses Abia Crises, ‘’Ikpeazu’s Rule, Crookedly Illegal’’

Human right activist and constitutional lawyer, Barrister Festus Keyamo has analysed the political imbroglio plaguing the eastern state of Abia has a sorry situation. The fire brand activist takes a critical look at the situation between incumbent governor, Dr. Okezie Ikpeazu and Dr. Sampson Uchechukwu-Ogah and this is what he said about the crises. On Monday, 27th day of June, 2016 the Federal High Court sitting in Abuja presided by Hon. Justice O. E. Abang nullified the nomination of Dr. Okezie Victor Ikpeazu as the candidate of the People’s Democratic Party for the 2015 Gubernatorial Election of Abia State and also his subsequent election as Governor of Abia State. The Court ordered the Independent National Electoral Commission to issue a Certificate of Return to Dr. Sampson Uchechukwu Ogah, who scored the second highest number of votes in the primaries that produced Dr. Okezie Victor Ikpeazu. A thorough scrutiny of the judgment of the court will reveal that, contrary to widespread opinion that Dr. Sampson Uchechukwu Ogah’s case was that Dr. Okezie Victor Ikpeazu presented forged tax papers to the Independent National Electoral Commission, his case was simply that Dr. Okezie Victor Ikpeazu apparently rushed to pay all his backlog of taxes just before the elections, yet he swore to a false affidavit and supplied a false information to the Independent National Electoral Commission that he paid his taxes AS AT WHEN DUE. It was based on this false information that the court nullified his candidature. OGAH’S CERTIFICATE OF RETURN I have carefully listened to various arguments regarding the immediate issuance of a Certificate of Return to Dr. Sampson Uchechukwu Ogah by the Independent National Electoral Commission in strict compliance with the judgment of the Court. Contrary to opinions expressed in certain quarters there is no judicial decision or statutory provision preventing the Independent National Electoral Commission from complying immediately with the Orders of the Federal High Court. The provision of Section 143(1) of the Electoral Act, Part VIII that gives Dr. Okezie Victor Ikpeazu (or any other office holder for that matter) 21 days within which to file an appeal against an adverse judgment (and to remain in office until the appeal is determined) applies only to post-election matters before election Tribunals or the Court of Appeal and not pre-election matters as in this case. In the circumstance, the Independent National Electoral Commission acted legally and correctly by instantly issuing a Certificate of Return to Dr. Sampson Uchechukwu Ogah. WHY DR. OKEZIE VICTOR IKPEAZU MUST STEP DOWN IMMEDIATELY AS GOVERNOR OF ABIA STATE It would have been permissible for Dr. Okezie Victor Ikpeazu to continue in office as Governor of Abia State pending the outcome of the appeal despite the judgment of the Federal High Court (and the nullification of his Certificate of Return) if Dr. Sampson Uchechukwu Ogah had not been issued a Certificate of return instantly. But having been issued a Certificate of Return, it is constitutionally abnormal and legally paradoxical that a person with a validly issued Certificate of Return should not occupy that office immediately, and the person with an invalidated Certificate of Return continues to occupy that office. That is why the Interim Order restraining the Chief Judge of Abia State or any other Judicial Officer from swearing in Dr. Sampson Uchechukwu Ogah is a non-sequitor as the judgment of Abang J has already been complied with by the Independent National Electoral Commission. The scenario we have now is that of a person, without any document entitling him to that office, occupying the office of Governor of Abia State, whilst a person who has both a valid court judgment and a valid Certificate of Return is unable to assume office as Governor of the state. Let the world know today that Dr. Okezie Victor Ikpeazu is operating illegally as Governor of Abia State and all his actions, orders and anything done in that capacity are null, void and of no effect. Dr. Sampson Uchechukwu Ogah should be sworn in immediately as Governor of Abia State pending the appeal lodged by Dr. Okezie Victor Ikpeazu. Nigerian Footballer Bags 8 Years Jail Term For Drugs In Cambodia

A Nigerian who described himself as a footballer was yesterday sentenced in Phnom Penh Municipal Court, Cambodia’s busiest capital city to eight years jail term and consequently fined a whopping 40 million riel (about $10,000) for drug trafficking. Francis Ihenwe Oderah, 30, had 100 grams of meth in his possession when he was arrested in Phnom Penh’s Choam Chao commune in January. During his hearing on June 7, the accused admitted having acted as a delivery man, but said he was not a dealer. It also was revealed that the meth he was carrying had a purity of about 72 per cent. Oderah will serve his jail term in Prey Sar prison where he's been detained since his arrest. The court judge, Svay Tonhalso ruled that three phones and a passport taken from the defendant upon his arrest will be returned.

I decided to make another design following the Skittles dress, I wanted to beat Lady Gaga’s meat dress. I wanted to beat her at the title of most disgusting dress so [asked] for pubic hair on Twitter. She revealed she spent the last six months working on the dress and was forced to wear gloves, plus a face and eye mask after she started gagging while making it. Grim. I set to work with my eye mask, breathing mask and thickest gloves I could find, because who wants to eat pubic hair? I thought of the design because of how gross it is. Other members of the reconstituted Board are Bayo Sanni, Idris Yakubu, Markie Idowu and Abimbola Izu, all of whom were serving in the Executive Director capacity of the Bank prior to now. The reconstitution of the Board followed the voluntary resignation of the former Chairman, Dr. Tunde Ayeni and other Non - Executive Directors of the Bank, namely, Mr. Victor Odozi, Mr. Babajide Agbabiaka, Dr. Jason Fadeyi, Mr. Kunle Aluko, Mr. Victor Adenigbagbe, Mr. Abdul Bello and Hajiya Amunna Lawan Ali. In the same vein, Mr. Timothy Oguntayo resigned his position as Group Managing Director / CEO, alongside Mrs. Amaka Onwughalu, Mr. Dotun Adeniyi and Mrs. Ibiye Ekong who resigned their positions as DMD, and Executive Directors. All the resignations take immediate effect. Nigeria Billionaire’s Fraudulent Past Threatens Hillary Clinton’s Political Dream

A very influential Nigerian billionaire living in the US, Kase Lawal may be threatening the political ambition of the favoured candidate, Hillary Clinton who’s on the verge of breaking records as America’s first ever female president. His influence in the USA has seen him befriending politicians in both Democratic and Republican parties, and this has earned him recognition, as reflected in his appointment by President Barack Obama into the White House’ Advisory Committee on Trade Policy and Negotiations. Though he was born in Ibadan, Oyo State, as Kase Lukman Lawal, his journey to the USA dates back to the time he spent to obtain his Bachelor of Science in Chemistry from Texas Southern University, in 1976, after which he had his MBA from Prairie View A&M University, also in Texas, in 1978. He then founded the CAMAC International Corporation, of which he still remains the Chairman and Chief Executive Officer (CEO). He’s also the Chairman of Allied Energy Corporation in Houston, Texas; and Chairman/Chief Executive Officer (CEO), CAMAC HOLDINGS. He is currently serving a seventh term as Commissioner to the Port of Houston Authority and as Vice-Chairman of the Houston Airport Development System Corporation. He is also a member of the National Urban League’s Board of Directors and the Fisk University Board of Trustees, and a significant shareholder in Unity National Bank, the only federally insured and licensed African-American-owned bank in Texas. Over the years, he’s been known to be a strong supporter of Mrs. Hillary Clinton. He was said to have, in 2000, single-handedly organised a fundraiser for the former American First Lady which generated more than $100,000. Clinton’s campaign lists Lawal among about 250 “Hillraisers” who pledged to collect at least $100,000 in donations for her then, and she attended a fund raising luncheon at Lawal’s home in Houston that generated more than $100,000, and she spoke to about 250 guests gathered around Lawal’s indoor swimming pool, including two former Houston mayors and Shell Oil President, John Hofmeister. His mention in the past in some fraudulent activities may cost whoever he’s supporting, going by the way and manner Donald Trump is going about his campaign, as Lawal was at a time mentioned in a spectacular fraud-related matter in the oil industry in Nigeria. He and others allegedly conspired to “steal” an oil block and pump millions of barrels of oil from it. Despite protracted legal proceedings (though he was never prosecuted and he has consistently denied the allegations), information revealed he was at a time on the list of the Economic and Financial Crimes Commission (EFCC) wanted Nigerians and this much was confirmed by the then Attorney-General, Mr. Michael Andoakaa, at a function back then. In 2003 the Mail & Guardian revealed how Lawal, after becoming close to former South African president, Thabo Mbeki, benefited from “what appears to be a fraud on the Nigerian and South African public”. It was reported that CAMAC, a company owned by Kase Lawal, had in that deal set up a subsidiary in South Africa, with the name “South African Oil Company”. This he was said to have done in association with a group of individuals connected to the ANC, South Africa’s leading and ruling political party. According to the report, Mbeki was said to have written to his then-counterpart in Nigeria, Chief Olusegun Obasanjo, chipping in good words about the company and supporting the company’s request for “a long-term crude oil contract on behalf of the Republic of South Africa”. This, it was said helped the company get substantial oil allocations at discounted “government-to-government” rates from Nigeria. The report explained further that the oil was however diverted as it was never taken to South Africa, with the proceeds paid into an account opened in the name of South African Oil Company at a bank in the Cayman Islands, where a mystery co-owner shared the proceeds with Kase Lawal-owned CAMAC. Kase and his CAMAC were also in the news over illegal transaction, this time in gold. In December 2010, Dikembe Mutombo, a Congolese basketball hero formerly with the Houston Rockets, was said to have introduced Lawal to the opportunity to buy 475kg of gold supposedly held in Kenya, and Lawal, we gathered, involved diamond trader Carlos St. Mary to help execute the gold deal with an agreement that Kase, Mutombo and St. Mary would split the estimated $10-million profit after the deal had been finalised. It however turned out later that the gold was actually being bought from a DRC Congo warlord who had been banned by the UN. The deal, it was gathered, cost Kase Lawal a sum to the tune of about $30 million which he could not recover as the deal was stopped by the ban decreed by President Joseph Kabila on all precious mineral exports from the eastern DRC, in an attempt to stop the financing of arms smuggling and destabilisation in the country. The intensity of the current electioneering campaign in America, which has seen the actors employing all sorts of measures to outdo one another, has seen some, especially Hilary Clinton, receiving backlash for her relationship with people like Kase Lawal. And it is only a matter of time before the Texas oilman’s name comes up for mention in the whole issue, especially if he raises any fund for the former Secretary of State in his capacity as a Hillraiser. Nigeria Prisons Fires Top Officers Over Abuja Jail Break

The Civil Defence, Fire, Immigration and Prisons Services Board (CDFIPB) has approved the suspension of four senior officers following the recent escape of two high profile inmates, Solomon Amodu and Maxwell Ajukwu, from Kuje Medium Security Prison. Kuje is a suburb of Abuja, Nigeria's capital city. Similarly, the Controller-General of Prisons, Ja'afaru Ahmed, has approved the suspension of 10 junior staff of the prison over the incident. This was contained in a statement on Monday by the spokesperson of the Nigeria Prisons Service, Francis Enobore, a deputy comptroller of prisons. Messrs. Amodu and Ajukwu, both standing trial for culpable homicide, escaped from the prison on June 24. The affected officers and men are DCP Musa Tanko, SIP Buhari Musa Dogo, PIP Stephen Edogbanya J and PIP Patrick Teru. The junior staff suspended are IP Usman Peter, IP Dennis B. Makum, IP, Fassan S. Akin, SPA Daka James, SPA Adamu Luka, SPA Zakari Yunasa and PA Asnamal Samuel. Others are PA Ejegwa Patrick, PA 11 Isah Ibrahim and PA 11 Ngede Salifu. The statement said the suspension of the prisons officials was "sequel to the outcome of the preliminary investigation into the incident and in consonance with PSR 030406 (2008) Revised Version." It also said the officers were suspended from duty to allow for unhindered trial process. It said the commissioned officers among them would be served with letters of query while the junior staff would be given Form 96 (Charge Sheet) to explain their role in the unfortunate saga. The statement also said efforts to recapture the fleeing prisoners in collaboration with sister security agencies were ongoing, adding "this is in addition to tightening security measures in and prison formations nationwide to forestall a repeat of such incident." It added, "The Controller General wishes to solicit the cooperation of members of the public to volunteer useful information that will assist in the recapture of the fugitives."

Abia In Interregnum As Ikpeazu, Ogah’s Battle Thickens

The political confusion over who is the rightful governor of the South-east state of Abia will endure at least until Thursday, when the Federal High Court, Abuja, will give its ruling on the stay-of-execution order filed by embattled Okezie Ikpeazu. The court on Monday fixed July 7 to rule on the application filed by Mr. Ikpeazu, whose election was annulled and certificate of return withdrawn. Mr. Ikpeazu filed the stay-of-execution application days after the court sacked him from office for failing to pay his personal income tax as at when due. Hearing the application on Monday, Justice Okon Abang declined to set aside his judgment, saying he would hear other applications on the matter on Thursday. The counsel to Mr. Ikpeazu, Wole Olanipekun, had asked the court to set aside the earlier order of a certificate of return given to Mr. Ogah. But counsel to Mr. Ogah, Alex Izinyon, filed a counter-affidavit against Mr. Ikpeazu’s application for stay of execution. Mr. Olanipekun then asked for time to look into the details of Mr. Izinyon’s argument in the counter-affidavit. He also prayed the court to treat the matter without delay. Justice Abang then fixed the next working day, July 7, to hear the application and other applications in the matter. The Federal Government has fixed Tuesday July 5 and Wednesday July 6 as public holidays so Nigerian muslims can join their counterparts around the world for end-of-Ramadan festivities. July 7 is the next working day in the country. Justice Abang had on June 27 sacked Mr. Ikpeazu as governor after the court found him guilty of tax evasion. Mr. Abang had, in that judgment, directed the Independent National Electoral Commission (INEC) to issue certificate of return to Mr. Ogah who came second in the primaries conducted by the Peoples Democratic Party in the state. In a swift reaction to the judgment, Mr. Ikpeazu filed an appeal before the Appeal Court in Abuja. He also filed a motion for stay of execution of the judgment at the Federal High Court. However in compliance with the court order, INEC issued Mr. Ogah a certificate of return on June 30, and he (Mr. Ogah) immediately headed to Abia to be sworn in as governor. But an Abia State High Court hurriedly issued an injunction stopping the state’s chief judge or any other judicial official in the state from administering the oath of office on Mr. Ogah, pending the determination of the motion on notice at the Court of Appeal. “Upon this motion ex-parte pursuant to section 143 (1) & (2) of the Electoral Act 2010 (as amended) and pending the determination of the motion on notice, after hearing O.O Nkume, counsel to the applicant,” Justice Chibuzo Ahuchaogu said. “It is ordered that an order of injunction is hereby made restraining the 2nd defendant (INEC) from issuing a certificate of return to the 1st defendant (Ogah) while the claimant (Ikpeazu) remains in office in accordance with section 143 (1) & (2) of the Electoral Act 2010 (as amended) and pending the determination of the motion on notice. “It is further ordered that the 3rd defendant (chief judge of Abia State) or any other judge of the court or any judiciary officer are hereby restricted from swearing-in the 1st defendant (Ogah) while the claimant (Ikpeazu) remains in office in accordance with section 143 (1) & (2) of the Electoral Act 2010 (as amended) and pending the determination of the motion on notice.” The state has, consequently, remained without a clear leadership since Thursday.

At Last! Controversial Ebola Movie, 93 Days Released

Remember it! The controversial story of how a Liberian imported the deadly Ebola disease into Nigeria which was adapted to be shot in a home video has finally been released. The movie directed by Steve Gukas is aimed at eulogizing the heroic deeds of the female doctor, Dr. Stella Adadevoh who gave her life to control and curtail the further spread of the disease in a Nigerian hospital. The script which tells more about Dr. Adadevoh’s life and bravery got the other side of her family as they kicked against the release of the movie for public consumption as it exposes much of the private life of their mother, sister and loved one, Dr. Adadevoh. In their response, the family issued an official statement to deny the producers of the movie who had said they got permission from the family before going ahead with the script. A court was later instituted to stop the work in progress but after oil has been poured in troubled water, the feuding parties seemed to have resolved the differences.
